These Terms & Conditions govern the purchase and use of the online bass course "Funk It Up!" provided through www.vincengarcia.com.
By placing an order, the customer confirms that they have read and accepted these Terms & Conditions.

2. THE COURSE
"Funk It Up!" is an online educational bass course created by Vincen García.
The course is intended primarily for intermediate to advanced electric bass players who wish to develop their technique, groove, musicality and understanding of funk bass playing.
Basic knowledge of the electric bass is recommended before taking the course.
The course includes more than 45 lessons covering topics including, among others:
Bass solos and grooves.
Pentatonic scales.
Greek modes.
Groove and rhythmic concepts.
Slap technique.
Ghost notes.
The diminished scale.
Licks and other techniques.
The course also includes supporting educational materials such as PDF tabs, theory materials, scale diagrams and backing tracks.
3. DIGITAL NATURE OF THE PRODUCT
The course is a digital product and is provided online.
No physical product is shipped.
Access to the course requires a compatible device and an internet connection.
The customer is responsible for having the necessary equipment and internet connection to access the course.
4. LANGUAGE
The course is originally recorded in Spanish and includes English translations generated using artificial intelligence.
The availability and quality of translated or AI-generated versions may vary between lessons.
The original Spanish version shall be considered the primary version of the course content.
5. PRICE
The applicable price of the course is the price displayed on the website at the time of purchase.
Unless otherwise stated, the price includes applicable taxes.
Promotional prices, discount codes or special offers may be subject to specific terms, conditions and validity periods indicated on the website.
6. PAYMENT
Payment must be completed through the payment methods made available on the website.
The customer authorises the relevant payment provider to process the transaction.
The purchase will only be considered completed once payment has been successfully authorised.
7. ORDER CONFIRMATION AND ACCESS
After successful payment, the customer will receive confirmation of the purchase and instructions for accessing the course.
Access may require the creation of a user account.
The customer is responsible for keeping their login credentials confidential and must not share their account with third parties.
8. LIFETIME ACCESS
The purchase provides the customer with lifetime access to the course.
For the purposes of these Terms, "lifetime access" means access for as long as the course remains available as an educational product operated by the Seller.
Lifetime access does not mean that the Seller guarantees that the website, hosting provider or any particular third-party technology will exist indefinitely.
The Seller may make reasonable technical changes to the platform or course delivery system where necessary.
Any such changes will not intentionally deprive customers of the access rights purchased under these Terms.
9. COURSE UPDATES
The Seller may update, improve, modify or expand the course content from time to time.
Where applicable, customers with lifetime access may receive access to such updates without additional payment.
The Seller does not guarantee that a specific number of future lessons, updates or additional materials will be added.
10. PERSONAL USE ONLY
Access to the course is personal and non-transferable.
The customer may use the course and its materials solely for personal educational purposes.
The customer must not:
Share their account or access credentials with other people.
Copy, reproduce or redistribute the course videos.
Upload course videos or materials to other websites or platforms.
Share, sell, sublicense or commercially exploit course materials.
Distribute PDF tabs, backing tracks, Guitar Pro files or other downloadable materials to third parties.
Record or reproduce the course for distribution.
Use the course materials to create a competing educational product without prior written permission.
Unauthorised distribution or sharing may result in the suspension or termination of access, without prejudice to any other rights or remedies available under applicable law.
11. INTELLECTUAL PROPERTY
All intellectual property rights relating to the course, including videos, audio, photographs, graphics, texts, tabs, arrangements, exercises, educational materials and other original content, belong to the Seller or their respective rights holders.
Purchasing the course does not transfer ownership or intellectual property rights to the customer.
The customer receives only a personal, limited and non-transferable right to access and use the course for educational purposes.
12. COPYRIGHTED MUSICAL MATERIAL
Some lessons may analyse, demonstrate or reference musical works created by third parties.
Such references are used as part of the educational content of the course.
No rights in third-party musical works are transferred to the customer through the purchase of the course.
13. CUSTOMER SUPPORT

The Seller will make reasonable efforts to respond to enquiries as soon as possible and normally within 48 hours.
Customer support does not include personalised private lessons unless expressly offered as a separate service.
14. RIGHT OF WITHDRAWAL
Under applicable consumer protection legislation, consumers generally have a period of fourteen (14) calendar days from the conclusion of the contract to exercise their right of withdrawal without giving a reason.
However, the right of withdrawal may not apply to the supply of digital content that is not supplied on a tangible medium once performance has begun, provided that the applicable legal requirements have been met.
By purchasing the course, the customer will be expressly asked to consent to immediate access to the digital content before the end of the fourteen-day withdrawal period and to acknowledge that, once the digital content is made available and performance has begun, the right of withdrawal may be lost in accordance with applicable law.
The customer's consent and acknowledgement will be obtained through the purchase process where required.
15. REFUNDS
If the customer has not consented to the immediate supply of the digital content and the legal requirements for withdrawal have not been fulfilled, the customer may exercise their statutory right of withdrawal within the applicable period.
Where the customer has expressly requested immediate access to the digital content, has acknowledged the consequences and the statutory exception applies, the right of withdrawal will not apply once the legal requirements for the exception have been satisfied.
Nothing in these Terms limits any mandatory consumer rights provided by applicable law.
16. CONFORMITY OF DIGITAL CONTENT
The Seller is responsible for ensuring that the digital content supplied conforms to the applicable legal requirements.
If the course or digital content does not conform to the applicable requirements, the customer may exercise the remedies provided by mandatory consumer protection legislation.

17. TECHNICAL REQUIREMENTS
The customer is responsible for having:
A compatible computer, tablet or mobile device.
A suitable internet connection.
A compatible web browser or application where required.
An electric bass or other equipment necessary to follow the practical exercises.
The Seller is not responsible for problems caused exclusively by the customer's device, internet connection, software or third-party services outside the Seller's reasonable control.
18. EDUCATIONAL DISCLAIMER
The course is an educational resource designed to help students improve their bass playing.
The Seller does not guarantee any particular level of musical improvement or professional outcome.
Results will depend on factors including the student's previous experience, practice habits, time invested and individual abilities.
19. AVAILABILITY OF THE PLATFORM
The Seller will make reasonable efforts to maintain access to the course.
However, temporary interruptions may occur due to maintenance, technical problems, hosting failures, internet issues, security incidents or circumstances beyond the Seller's reasonable control.
Where reasonably possible, the Seller will take appropriate measures to restore access.
20. SUSPENSION OR TERMINATION OF ACCESS
The Seller may suspend or terminate a customer's access where there is a serious or repeated breach of these Terms, including unauthorised distribution of course materials or sharing of account credentials.
Such action will be taken in accordance with applicable law and will not affect any mandatory rights of consumers.

Where the customer is a consumer, nothing in these Terms shall deprive the customer of any mandatory rights or protections granted by the laws applicable to their place of residence.
